Notice of the passing of a Zoning By-Law
NOTICE OF THE PASSING OF A ZONING BY-LAW
BY THE CORPORATION OF THE TOWN OF HEARST
pursuant to the Planning Act, R.S.O. 1990, as amended and
Ontario Regulation No. 545/06
TAKE NOTICE that the Council of the Corporation of the Town of Hearst passed By-law No. 20-2025 on April 8, 2025, under Section 34 of the Planning Act, R.S.O. 1990. The complete by-law is available for inspection at the Hearst Town Hall, 925 Alexandra Street, Hearst, Ontario, during regular business hours, Monday through Friday, between 8:30 a.m. and 4:00 p.m.
AND TAKE NOTICE that any person or public body may appeal this by-law to the Ontario Land Tribunal (OLT) by filing a notice of appeal with the Clerk of the Town of Hearst on or before April 29, 2025. The notice of appeal to the OLT must set out the reasons for the appeal of the by-law and be accompanied by the fee prescribed under the applicable legislation. Only individuals, corporations, and public bodies may appeal a by-law to the OLT. A notice of appeal cannot be filed by an unincorporated association or group. However, a notice of appeal may be filed by an individual who is a member of the association or group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made a submission to the Council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
PURPOSE AND EFFECT OF BY-LAW NO. 20-2025
The amendment modifies Section 3.1.8 of the Hearst Zoning By-law No. 76-19 to regulate the use of portable buildings as alternatives to storage sheds. The amendment includes:
- Allowing shipping containers in all zones except residential zones.
- Requiring compliance with accessory building regulations in the relevant zone.
- Permitting up to three (3) containers per property in rural and institutional zones.
- Ensuring containers are painted and maintained to harmonize with surrounding structures.
- Requiring building permits for installation.
- Removing the need for site plan control agreements and time limits for use in commercial zones.
