NOTICE OF STATUTORY PUBLIC MEETING

NOVEMBER 12, 2019 AT 6:30 P.M.

Review of the Town of Hearst’s and the Hearst Planning Board’s Zoning By-laws

PLEASE BE ADVISED that the Town of Hearst and the Hearst Planning Board invite all those interested to attend this Statutory Public Meeting on proposed amendments to the Town of Hearst’s Zoning By-law and the Unorganized Territories of the Hearst Planning Area’s (Hearst Planning Board) Zoning By-law.

The purpose of this Statutory Public Meeting is to consider revisions and provide input on the Zoning By-laws final draft, pursuant to the requirements of Section 34(12) of the Planning Act, RSO 1990, as amended.

The Zoning By-laws are legal documents that implement the policies of the Hearst Planning Area Official Plan. The Zoning By-laws translate the land use planning objectives and policies of the Official Plan into detailed standards for how a property may be developed, including the types of uses that are permitted on a property, where buildings and other structures can be located, lot sizes and dimensions, parking requirements, building heights, and setbacks from streets.

PURPOSE AND EFFECT: The Town of Hearst and the Hearst Planning Board are undertaking the legislated review and update of their Zoning By-law as required by the Planning Act. The Town of Hearst’s existing Zoning By-law was approved by Council in 2005 and applies to the Town of Hearst. The Hearst Planning Board’s existing Zoning By-law was approved by the Hearst Planning Board in 1996 and applies to the unorganized townships within the Hearst Planning Area (Casgrain, Hanlan, Kendall, Lowther and Way). Pursuant to the Planning Act, each Zoning By-law must be updated to comply with the Official Plan of the Hearst Planning Area, as approved by the Ministry of Municipal Affairs and Housing in November 2017.

THE SUBJECT LANDS of the final draft of the Town of Hearst’s Zoning By-law includes the entirety of lands located within the Town of Hearst’s municipal boundary. The subject lands of the final draft of the Unorganized Territories of the Hearst Planning Area’s Zoning By-law includes the entirety of unorganized lands within the Hearst Planning Area (Geographic Townships of Casgrain, Hanlan, Kendall, Lowther and Way). As such, no key map is provided.

IF A PERSON OR PUBLIC BODY would otherwise have the ability to appeal the decision of the Council of the Town of Hearst or the Hearst Planning Board to the Local Planning Appeal Tribunal, but the person or public body does not make oral or written submissions at a public meeting or does not provide written submissions to the Town of Hearst or the Hearst Planning Board before the by-laws amending the Zoning By-laws are adopted, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

IF A PERSON OR PUBLIC BODY does not make oral submissions at a public meeting, or provide written comments to the Town of Hearst or the Hearst Planning Board before the by-laws amending the Zoning By-laws are adopted, the person or public body is not entitled to appeal the decision of the Council of the Corporation of the Town of Hearst or the Hearst Planning Board to the Local Planning Appeal Tribunal.

ANY PERSON may attend the Statutory Public Meeting and/or make written or verbal representation either in support of or in opposition to the proposed Zoning By-laws of the Town of Hearst and/or the Hearst Planning Board. If you wish to be notified of the decision of the Council of the Town of Hearst or the Hearst Planning Board on the proposed Zoning By-laws, you must make a written request to the Town of Hearst or the Hearst Planning Board at the address below.
